These Terms of Service ("Terms") govern your use of the website of The Bank ("The Bank,""we," "us," or "our"), located at 59 Pope Ave, Hilton Head Island, SC 29928, and any purchases you make through it. By accessing our website, subscribing to our newsletter, or purchasing a gift card, you agree to these Terms. If you do not agree, please do not use our website.
The Bank is a brand of Moon King Entertainment Group, which operates the website and is the entity responsible for these Terms. Moon King Entertainment Group's other brands include Burnt Church Distillery, Hail Mary's Spirits & Sports Bar, Amethyst NA Spirits, Side Hustle Brewing Co., Old Route 69 Brewery, and The Press Room.
Eligibilty
You must be at least 18 years old to use our website, subscribe to our newsletter, or purchase a gift card. Certain areas of our website relate to alcoholic beverages and are intended only for visitors who are of legal drinking age in their jurisdiction. By using those areas, you confirm that you are 21 years of age or older. We reserve the right to refuse service, cancel orders, or restrict access where we reasonably believe an age requirement has not been met.
Alcohol is not sold through our website. Alcohol at The Bank is served and sold only atour licensed physical location, in accordance with South Carolina law.
Use of Our Website
You may use our website for your own personal, non-commercial purposes: viewing menus, hours, and events, subscribing to our newsletter, and purchasing gift cards. You agree not to:
- Use our website for any unlawful purpose or inviolation of these Terms
- Attempt to gain unauthorized access to any part of our website, servers, or accounts
- Interfere with or disrupt the operation of our website, including through automated scraping, bots, or denial-of-service activity
- Submit false, misleading, or fraudulent information, including about your age or identity, or in connection with a gift card purchase
- Copy, reproduce, or redistribute content from our website without our written permission
- Resell gift cards or use them for any commercial purpose without our written authorization
We may suspend or terminate your access to our website at any time, without notice, if we believe you have violated these Terms.
Newsletter and Email Communications
When you submit your email address through a form on our website, you consent to receive newsletters, event announcements, promotions, and updates from The Bank and Moon King Entertainment Group's other brands. Email frequency varies. You can unsubscribe at any time using the link at the bottom of any marketing email we send, or by contacting us at info@moonkingentertainment.com.
We may still send you transactional messages relating to an order you place, such as gift card confirmations and delivery notices, even if you have unsubscribed from marketing email.
Gift Cards
Gift cards are sold and administered through Toast, our payment and gift card provider. By purchasing a gift card, you agree to the following terms in addition to any terms presented at checkout.
- Redemption. Gift cards are redeemable at any Moon King Entertainment Group brand, regardless of which brand the card was purchased through, including The Bank, Burnt Church Distillery, Hail Mary's Spirits & Sports Bar, Amethyst NA Spirits, Side Hustle Brewing Co., Old Route 69 Brewery, and The Press Room. If we add or remove a brand or location, the brands participating at the time of redemption will apply.
- No expiration. Gift cards do not expire and are not subject to dormancy, inactivity,or service fees, except as permitted by applicable law.
- No cash value. Gift cards may not be redeemed for cash, except where required by law, and cannot be applied to a previously completed purchase.
- Non-refundable. Gift card purchases are final and non-refundable once delivered.
- Delivery. Gift cards are delivered electronically to the email address provided at checkout. You are responsible for entering the correct recipient email address. We are not responsible for gift cards delivered to an incorrect address supplied by you, or for delivery failures caused by spam filters or an inactive email account.
- Lost or stolen cards. We are not responsible for gift cards that are lost, stolen, forwarded, or used without your permission. Treat a gift card code like cash.
- Balances. Any unused balance remains on the gift card. If a purchase exceeds the balance, the difference must be paid by another accepted payment method.
- Alcohol. Gift cards may be used toward alcoholic beverages only where permitted by law and only by guests of legal drinking age, at the discretion of the serving location. Gift cards cannot be used for online bottle purchases from Burnt Church Distillery.
Toast's processing of your payment and gift card information is governed by its own terms and privacy policy. We are not responsible for outages, errors, or delays caused by Toast or other third-party providers.
Pricing, Orders, and Payment
All prices are shown in U.S. dollars and are subject to change without notice. We make reasonable efforts to keep pricing and product information accurate, but errors can occur. If a gift card or other item is listed at an incorrect price, we reserve the right to cancel or refuse the order, even after a confirmation has been sent, and to refund any amount charged.
Gift card payments are processed by Toast at the time of purchase. By submitting an order, you represent that you are authorized to use the payment method provided. We reserve the right to refuse or cancel any order we reasonably believe to be fraudulent, unauthorized, or otherwise in violation of these Terms.
Menus, Hours, and Availability
Menus, pricing, hours of operation, events, and product availability shown on our website are provided for general information and are subject to change without notice. Items, offerings, and events may be modified, suspended, or discontinued at any time. We recommend contacting us directly to confirm current hours and availability before visiting.
Nutritional, allergen, and ingredient information, where provided, is approximate. Our kitchens handle common allergens, and we cannot guarantee that any item is freefrom a specific allergen. If you have a food allergy or dietary restriction, please speak with a manager before ordering.
Intellectual Property
All content on our website, including text, graphics, logos, brand names, photographs, menus, videos, and site design, is owned by Moon King Entertainment Group or its licensors and is protected by copyright, trademark, and other intellectual property laws. The Bank name and logo are trademarks of Moon King Entertainment Group or its affiliates.
You may view and share our content for personal, non-commercial purposes. You may not reproduce, distribute, modify, or use our content or trademarks for commercial purposes without our prior written consent.
Your Submissions
If you send us feedback, reviews, photographs, suggestions, or other materials, or tag The Bank on social media, you grant Moon King Entertainment Group a non-exclusive, royalty-free, worldwide license to use, reproduce, and display those materials in connection with our marketing and operations, with attribution where practical. You represent that you own or have the right to share anything you submit, and that it does not infringe the rights of any third party. We are not obligated to use, and may remove, any submission.
Third-Party Services and Links
Our website is hosted on Webflow, our email marketing is delivered through Mailchimp, and gift card sales are processed through Toast. Our website may also link to third-party services such as social media platforms, reservation or ticketing providers, delivery partners, and the websites of our sister brands. We do not control these services and are not responsible for their content, availability, terms, or practices. Your use of a third-party service is governed by that provider's own terms.
Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using our website, you also agree to the terms of our Privacy Policy.
Disclaimers
Our website and all content on it are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. To the fullest extent permitted by law, our total liability arising out of or relating to these Terms or your use of our website will not exceed the amount you paid to us in the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and any terms presented at checkout, are the entire agreement between you and Moon King Entertainment Group, including The Bank, regarding your use of our website.
